Ownership and Originality
The Author warrants and promises that they will retain full ownership of all rights and licenses, including all creative assets within the “material” referred to as the book cover design, interior design, layout, illustrations, and book content.
The Author affirms, declares, and guarantees in good faith that they are the sole owner of the manuscript and the copyright to its contents and appendices in the topic “material.” The Author is responsible for ensuring that the “material” does not violate third parties Intellectual Property Rights (IPR). Should a case and/or dispute involving Intellectual Property Rights (IPR) in the contents and images of the “material” arise, the Author agrees to protect Trusted Stories so that the latter is not held liable, whether civilly or criminally, etc., by the owner of the infringed Intellectual Property Rights (IPR), and the Author shall bear ALL related expenses. If the “material” is ultimately determined to have violated the Intellectual Property Rights (IPR) of a third party after Trusted Stories has begun marketing it, the Author is obligated to pay Trusted Stories the total amount of the agreed-upon marketing fee as well as damages in an amount equivalent to the marketing fee.
Marketing Fee and Mode of Payment
The aforementioned marketing cost is due upon signing of this contract. If the Author makes a payment in a currency other than USD, the Author shall pay the difference between the amount paid as translated to USD at the prevailing exchange rate (“USD Equivalent”) and the USD Purchase Price (“Shortfall”). If the payment is made with a debit or card, the Author expressly authorizes Trusted Stories to charge the credit or debit card for the agreed-upon marketing fee.
The Author certifies that they have the legal right and authorization to grant Trusted Stories permission to use the payment information provided herein. Consequently, the Author agrees to indemnify and hold Trusted Stories blameless for any claims arising from Trusted Stories’s use of the Author-supplied payment information for purposes of paying the marketing charge. In the event that the Author rescinds the aforementioned authorization, Trusted Stories will only honor such a revocation if it is submitted in writing; furthermore, the payment amount must be paid prior to the revocation taking effect. Trusted Stories is not liable for any fees the Author may incur due to inadequate funds at the time the payment is processed using the Author’s provided payment details.
Mode of Marketing
The Author has selected and elected Trusted Stories to promote, market, sell, and distribute “BOOK TITLE” via SERVICE NAME. Trusted Stories will interact with a vast network of distributors, vendors, and marketers and apply the most efficient, industry-approved marketing formulae and techniques to increase a book’s selling points.
However, Trusted Stories does not promise a particular number of book sales or “material” sales. Trusted Stories provides no guarantees or assurances regarding the minimum effectiveness of the services or the number of book sales resulting from the aforementioned marketing strategy. If the Author chooses and intends to utilize any additional marketing services not included in the method of marketing selected above, or if the Author changes the mode of marketing specified herein, a separate cost will apply.
Commencement of Marketing Services
Trusted Stories shall immediately begin marketing the book labeled “BOOK TITLE” upon receipt of the aforementioned marketing price in full, and the subject “content” has already been provided to Trusted Stories and is marketing-ready.
Obtainability and Distribution
As part of the Author’s package, books are available to customers in the format (e-book, softcover, hardcover) selected by the Author. As long as the Author wants to keep them in print, they will remain accessible. If the Author desires to print their book for personal sale, Author Volume Discounts are available among his printing alternatives.
Invalidation
In the event that any of the terms, conditions, limitations or other provisions included herein are invalidated by a court order or decision, the validity of the other terms, conditions, restrictions, and provisions shall not be affected and shall continue in full force and effect.
Venue
In the event that litigation arises out of this agreement, the parties have agreed that the forum shall be the courts of Las Vegas, Nevada, USA, to the exclusion of all others.
Non-waiver
The failure of Trusted Stories to insist on strict performance of any of the terms, conditions, and covenants herein shall not be construed as a relinquishment or waiver of any rights or remedy that it may have, nor as a waiver of any subsequent breach or default of the terms, conditions, and covenants shall remain in full force and effect.
No waiver by Trusted Stories of any of its rights under this agreement shall be regarded as effective unless done in writing and signed by Trusted Stories’s owner.
